Terms and Conditions for Rent-a-Refresh
1. Agreement to Terms
By renting equipment from Rent-a-Refresh, the customer (referred to as “Lessee”) agrees to adhere to these Terms and Conditions. Rent-a-Refresh (“Lessor”) reserves the right to modify these Terms and Conditions at any time.
2. Rental Period
• The rental period begins on the date the equipment is picked up or delivered and ends on the agreed-upon return date.
• Late returns may incur additional fees, charged daily.
3. Payment and Fees
• Payment is due upfront, including rental charges, a refundable security deposit, and any applicable taxes.
• Late fees apply if the equipment is not returned by the agreed time.
4. Security Deposit
• A refundable security deposit is required for each rental.
• The deposit will be refunded upon satisfactory return of the equipment in good condition, less any charges for damages or additional cleaning required.
5. Equipment Care and Use
• Lessee is responsible for using the equipment only for its intended purpose and following any manufacturer instructions provided.
• The equipment must not be modified, subleased, or used by anyone not named in the rental agreement.
6. Damage and Liability
• Lessee assumes full responsibility for the equipment from the time it leaves Rent-a-Refresh’s premises until it is returned.
• In case of loss or damage beyond normal wear and tear, Lessee agrees to cover the cost of repair or replacement.
• Lessor is not liable for any injuries or damages resulting from the misuse of rented equipment.
7. Maintenance and Repairs
• Lessee must notify Rent-a-Refresh immediately if the equipment is damaged, malfunctions, or requires repair.
• Lessor will arrange for repair or replacement if necessary. Unauthorized repairs by the Lessee are not allowed.
8. Cancellations and Refunds
• Cancellations made 48 hours prior to the rental start date are eligible for a full refund.
• Cancellations made after this period may incur a cancellation fee.
9. Limitation of Liability
• Rent-a-Refresh is not liable for any direct, indirect, or consequential damages resulting from the Lessee’s use or misuse of the rented equipment.
• Lessee agrees to assume full responsibility for any injuries or damages that may arise during the use of the rented equipment.
10. Indemnification
• Lessee agrees to indemnify and hold Rent-a-Refresh harmless from any claims, damages, or losses, including legal fees, arising from the use of the rented equipment.
11. Return of Equipment
• Equipment must be returned by the agreed-upon return date and time.
• Equipment should be clean and in the same condition as at the time of rental. Additional cleaning fees may apply if equipment is returned dirty.
12. Governing Law
These Terms and Conditions are governed by the laws of the state of Victoria, Australia, and any disputes will be resolved in the courts of Victoria.
13. Entire Agreement
This document constitutes the entire agreement between the Lessor and Lessee, and any modifications must be in writing and signed by both parties.
